By signing this liability waiver, you acknowledge and accept the following terms regarding your use of the facilities and tools operated by “O'Town Makerspace”.
1. Age and Capacity
By signing this liability waiver I declare that I am of the age of 18 and magisterial and that my use of facilities and tools etc. that belong to “O'Town Makerspace” happens entirely at my own risk.
2. Physical Condition
I have been informed about and accept that the use of tools and facilities requires high levels of concentration, physical strength and good behavior. I therefore declare that I am in good physical condition, and that I am not affected by alcohol, narcotics or medicine that would affect my ability to use the facilities and tools. I am informed about that the uses of the facilities and tools can pose a risk or be dangerous to, people with heart problems, high blood pressure, pregnancy and people with back/spine damages. These are in the high risk group and are therefore not allowed to use the facilities and tools at “O'Town Makerspace”.
3. Compliance with Guidelines
I have been informed about and accept that I must follow all guidelines, which are provided by employees, volunteers and representatives of “O'Town Makerspace” during my stay at their facilities.
4. Liability for Damages
I have been informed about and accept that I am liable of damages to the facilities, the tools and other equipment used by “O'Town Makerspace” so forth that I have acted negligently, performed vandalism or ignored guidelines given to me by employees, volunteers or representatives of “O'Town Makerspace”.
5. Property Damages
I have been informed about and accept that “O'Town Makerspace” is NOT liable for eventual damages to property because of negligence or shortcomings by “O'Town Makerspace” or a third-party and that “O'Town Makerspace” is NOT liable for lost property.
6. Injuries or Death
I have been informed about and accept that “O'Town Makerspace” is NOT liable for any possible injuries or death that I might incur on myself or a third party as a result of using the facilities and tools etc. This also includes injuries occurred during my stay at or in the vicinity of the facilities.
7. Third-Party Negligence
I have been informed about and accept that “O'Town Makerspace” is NOT liable for any injuries or death occurred as a result of negligence or shortcomings by “O'Town Makerspace” or any third party as a result of using the facilities or tools etc. This also includes injuries or death occurred during my stay at or near the vicinities of the facilities.
8. No Redress
I have been informed about and accept that I can NOT seek redress against “O'Town Makerspace” for the liability claims that might be claimed against me.
9. Exceptions
This liability waiver does not cover damages for negligent acts or shortcomings of the same nature by “O'Town Makerspace” or its employees, volunteers and representatives.
10. Liability Cap
I have been informed about and accept that in the case of “O'Town Makerspace” being found liable despite this liability waiver, then the liability claim is limited to 25 million DKK.
11. Minors and Dependents
I have been informed about and accept that this liability waiver also covers the eventuality of minors, people whom I am guardian for or responsible for in some manner in the case of property damages or injuries and death when using the facilities and tools etc. This also applies to staying at the facilities or nearby vicinity.
